When a couple divorces, there must necessarily be a division of marital property. Marital property is defined as any income or property earned or acquired by either spouse during the marriage. Examples of marital property include the family home, income earned by either party, stocks and bonds, and retirement accounts.

The general rule is that marital property is divided equally when the marriage is dissolved. There are several exceptions to the general rule that exempts certain types of assets from being divided, such as gifts and inheritances received by only one party.

The division of marital property is often known as "equitable distribution". This implies that there will be a fair accounting of all marital property and that it will be distributed equally between the parties.
